2: People need to write more precise contracts. "Since it would never come up that you would not pay me, then a penalty clause is nothing to be afraid of. Contrawise, since I would never not deliver, a penalty on me here will be of no issue..."
Almost certainly, given who is commenting on them both. Part of the issue is MWP contracted with nearly half of the Story Games in-crowd, only a few of whom had done professional work before.
